GST on coworking and office rent in India

The GST rate on office rent, input tax credit, reverse charge on unregistered landlords and using a coworking address for GST registration, with sources. · Updated 31 October 2026

GST shows up on almost every coworking and office invoice. This guide sets out what the official notifications say about the rate, input tax credit and using a rented or shared office as your registered place of business, with a link to each source. It is general information, not tax advice: confirm your own case with a chartered accountant.

The rate on renting commercial property

The services classification used for GST puts "rental or leasing services involving own or leased non-residential property" under SAC 997212, in heading 9972, "Real estate services" (annexure to Notification 11/2017-Central Tax (Rate)).

Notification 11/2017-Central Tax (Rate) sets central tax (CGST) at 9% for heading 9972 (Notification 11/2017-Central Tax (Rate), serial 16). On a supply within one state, state tax (SGST) or Union territory tax is charged alongside CGST under the matching state notification.

On a supply between states, integrated tax (IGST) applies. The IGST rate notification, as amended up to 1 April 2019, lists "real estate services other than (i) and (ii) above" under heading 9972 at 18% (Notification 8/2017-Integrated Tax (Rate), as amended).

The rate changes recommended at the 56th GST Council meeting in September 2025 did not include heading 9972 (GST Council press release, 56th meeting).

A coworking membership may not be billed as renting. How an operator classifies its supply is its own call, so check the SAC code and the tax rate printed on the invoice, and ask the operator if they are unclear.

Renting from an unregistered landlord: reverse charge

From 10 October 2024, when an unregistered person rents out any property other than a residential dwelling to a registered person, the tenant pays the GST under reverse charge (Notification 09/2024-Central Tax (Rate)). From 16 January 2025 this does not apply to tenants who pay tax under the composition levy (Notification 07/2025-Central Tax (Rate)).

This matters mainly for a conventional lease. A coworking operator that issues you a GST invoice is registered, so the reverse-charge entry for unregistered landlords does not apply to that invoice.

Claiming input tax credit

A registered business can take credit for GST charged on services it uses "in the course or furtherance of his business" (CGST Act, section 16(1)). Section 16(2) sets conditions, including that you:

  • hold a tax invoice or debit note from a registered supplier;
  • see the invoice details in the supplier's statement of outward supplies, as communicated to you;
  • have received the service;
  • the tax charged has actually been paid to the Government; and
  • have filed your own return under section 39.

Some credits are blocked by section 17(5). One that matters for offices: credit is not available on goods or services received for construction of an immovable property on your own account, and "construction" includes renovation, additions or alterations to the extent they are capitalised (CGST Act, section 17(5)(d) and Explanation). Ask your accountant how this applies to a fit-out.

In practice: make sure the operator's invoice carries your GSTIN and the correct state, and that it appears in your purchase data before you claim the credit.

Using a coworking address for GST registration

GST registration asks for proof of your principal place of business. CBIC's Instruction No. 03/2025-GST (17 April 2025) tells officers what is enough (CBIC Instruction 03/2025-GST):

  • Rented premises: the valid rent or lease agreement plus any one document showing the lessor owns the premises, such as the latest property tax receipt, municipal khata copy or electricity bill.
  • Unregistered agreement: the above plus a copy of the lessor's identity proof. If the agreement is registered, the lessor's identity proof should not be sought.
  • Shared premises with an agreement: the agreement plus one of the ownership documents above, with the same rule on identity proof.
  • Shared premises without an agreement: a consent letter on plain paper from the owner, with the owner's identity proof and one ownership document.

Before you sign, ask the operator whether your plan includes registration use, which of these documents they will give you, and how quickly. Our agreement checklist covers the other terms to check.

Frequently asked questions

What GST rate applies to commercial office rent?

Renting of non-residential property falls under heading 9972. Notification 11/2017-Central Tax (Rate) sets CGST at 9% for that heading, charged with state tax on a supply within a state; between states, the IGST notification lists it at 18%. Check the rate on your invoice.

Can I claim input tax credit on coworking rent?

A registered business can claim credit for GST on services used in the course or furtherance of its business, if the conditions of section 16(2) of the CGST Act are met: a valid tax invoice from a registered supplier, invoice details reported by the supplier, the service received, tax paid and your own return filed.

Can I use a coworking address for GST registration?

Yes, if you can show the documents CBIC Instruction 03/2025-GST describes: for shared premises, the rent or lease agreement plus one document showing the owner's ownership (with the lessor's identity proof if the agreement is unregistered), or without an agreement, a consent letter from the owner with their identity proof and one ownership document. Confirm with the operator that your plan allows it.

Do I pay GST under reverse charge on coworking?

The reverse-charge entry for renting covers property rented by an unregistered person to a registered person. A coworking operator that issues a GST invoice is registered, so that entry does not apply to its invoice.
